1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and TradieMate ("Company", "we", "our", or "us") regarding your use of our platform and services.

By accessing or using TradieMate, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our services.

2. Service Description

TradieMate provides AI-powered quoting and invoicing software designed for Australian trade professionals. Our services include:

  • Photo-to-quote generation using artificial intelligence
  • Professional invoice creation and management
  • Integration with supplier pricing databases (Bunnings, Reece)
  • Accounting software integration (Xero, MYOB)
  • Payment processing through third-party providers
  • Job tracking and business management tools

3. Eligibility

To use TradieMate, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Operate a legitimate trade business in Australia
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

4. Subscription Plans and Billing

4.1 Plans

We offer multiple subscription tiers (Starter, Pro, Premium) with varying features and usage limits. Current pricing and features are available on our pricing page.

4.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • All prices are in Australian Dollars (AUD) and include GST
  • Payment is processed through Stripe or other approved payment processors
  • You authorize us to charge your payment method on each billing cycle
  • Failed payments may result in service suspension or termination

4.3 Free Trial

We may offer a 14-day free trial for new users. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and your payment method will be charged.

4.4 Price Changes

We reserve the right to modify subscription prices with 30 days' notice. Price changes will not affect your current billing cycle.

5. Cancellation and Refund Policy

5.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

5.2 Refunds

  • Monthly Plans: No refunds for partial months. Service continues until the end of the billing period.
  • Annual Plans: Pro-rated refunds available within 30 days of purchase. After 30 days, no refunds are provided.
  • Free Trial: Cancel anytime during the trial period to avoid charges.
  • Exceptions: Refunds may be issued at our discretion for service outages or technical failures.

6. User Responsibilities and Acceptable Use

6.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

6.2 Prohibited Activities

You agree not to:

  • Use the service for illegal purposes or to violate any laws
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer, decompile, or disassemble our software
  • Resell or redistribute our services without permission
  • Use automated tools to scrape or extract data
  • Impersonate others or provide false information
  • Harass, abuse, or harm other users

7. AI-Generated Quotes and Pricing Disclaimer

Quotes generated by TradieMate's AI are estimates only and should not be considered final or guaranteed pricing.

7.1 Pricing Data Sources

Our AI uses pricing data sourced from public supplier catalogues, databases, and historical pricing information. This data:

  • May not reflect current real-time prices
  • Can vary by location, supplier, and availability
  • Does not include special promotions, bulk discounts, or trade account pricing
  • Is updated regularly but may contain inaccuracies

7.2 User Verification Required

You must always verify pricing with your suppliers before providing quotes to customers. TradieMate is not responsible for:

  • Price discrepancies between AI estimates and actual supplier prices
  • Financial losses resulting from inaccurate quotes
  • Customer disputes arising from pricing errors
  • Changes in supplier pricing after quote generation

7.3 AI Limitations

Our AI technology is designed to assist, not replace, professional judgment. The AI may misinterpret photos, miscalculate quantities, or suggest inappropriate materials. Always review and adjust AI-generated quotes based on your expertise and site-specific conditions.

8. Intellectual Property

8.1 Our Rights

TradieMate and all related trademarks, logos, software, and content are owned by us or our licensors. You may not use our intellectual property without written permission.

8.2 Your Content

You retain ownership of content you upload (photos, quotes, invoices). By using our service, you grant us a license to use, store, and process your content to provide our services.

9. Limitation of Liability

To the maximum extent permitted by Australian law:

  • TradieMate is provided "as is" without warranties of any kind
  • We do not guarantee uninterrupted, error-free, or secure service
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months
  • We are not responsible for third-party integrations or external services

Nothing in these Terms excludes guarantees or warranties that cannot be excluded under the Australian Consumer Law.

10. Data and Privacy

Your use of TradieMate is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with Australian privacy laws.

11. Termination

We may suspend or terminate your account if you:

  • Violate these Terms
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Abuse or misuse our services

Upon termination, you will lose access to your account and data. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification. Continued use of our services after changes constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.

Before initiating legal action, you agree to attempt to resolve disputes through good-faith negotiation or mediation.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
